LIABILITY WAIVER, ASSUMPTION OF RISK & RENTAL AGREEMENT

IMPORTANT NOTICE PLEASE READ THIS DOCUMENT CAREFULLY. BY SIGNING THIS AGREEMENT, YOU MAY BE GIVING UP CERTAIN LEGAL RIGHTS. IF YOU DO NOT UNDERSTAND ANY PORTION OF THIS AGREEMENT, DO NOT SIGN IT UNTIL YOU HAVE RECEIVED CLARIFICATION. SECTION 1: ACKNOWLEDGEMENT OF RISK I understand that operating an electric scooter involves inherent risks that cannot be completely eliminated regardless of the care taken by Island Escape Rentals. These risks may include but are not limited to: * Falling from the scooter * Loss of control * Mechanical failure * Road hazards * Potholes * Uneven pavement * Sand and gravel * Wet surfaces * Vehicle collisions * Pedestrian collisions * Animal encounters * Poor weather conditions * Personal negligence * Negligence of other road users I understand that these risks may result in: * Minor injury * Serious injury * Permanent disability * Death * Property damage * Financial loss I knowingly and voluntarily assume all such risks. SECTION 2: PHYSICAL CONDITION I certify that: * I am physically capable of safely operating an electric scooter. * I do not suffer from any condition that would impair my ability to safely operate rental equipment. * I understand that operating an electric scooter requires balance, coordination, and awareness. I understand that Island Escape Rentals has made no representation regarding my physical ability to safely operate equipment. SECTION 3: SAFE OPERATION REQUIREMENTS I agree to: * Operate the scooter responsibly * Follow all local traffic laws * Follow all instructions provided by Island Escape Rentals * Operate at safe speeds * Exercise caution around pedestrians * Exercise caution in crowded areas * Exercise caution near beaches and waterfronts I understand that failure to do so may increase my risk of injury. SECTION 4: PROHIBITED ACTIVITIES I agree NOT to: * Operate under the influence of alcohol * Operate under the influence of drugs * Race the scooter * Perform stunts * Jump curbs intentionally * Operate recklessly * Carry unauthorized passengers * Allow another person to operate the scooter * Tamper with any tracking device * Tamper with any security device * Attempt repairs * Operate beyond my skill level Violation of these provisions may result in immediate termination of the rental without refund. SECTION 5: EQUIPMENT INSPECTION I acknowledge that I have had the opportunity to inspect all rental equipment prior to use. Rental equipment may include: * Electric Scooter * Helmet * Cooler Backpack * Dry Bag * Beach Mat * Beach Chair * Snorkel Equipment * Charger * Other Rental Accessories I agree to report any concerns before beginning the rental period. Failure to report damage prior to use may result in damage being attributed to my rental period. SECTION 6: HELMET ACKNOWLEDGEMENT I understand that helmet use may significantly reduce the risk of serious injury. I acknowledge that: * A helmet was offered. * A helmet was accepted. OR * I voluntarily declined a helmet. I assume all risks associated with my decision. Initials: SECTION 7: FINANCIAL RESPONSIBILITY I understand that I am financially responsible for: * Damage * Theft * Loss * Missing accessories * Recovery costs * Cleaning fees * Late return fees I understand that a refundable security deposit is required. I understand that the security deposit may be applied toward: * Damage * Missing equipment * Recovery fees * Cleaning fees * Late fees I further understand that the security deposit is NOT a limit of liability. If damages exceed the security deposit amount, I agree to remain financially responsible for all additional costs. SECTION 8: MEDICAL AUTHORIZATION In the event of an emergency: I authorize emergency personnel to provide treatment deemed necessary. I understand that: * Medical costs are my responsibility. * Island Escape Rentals is not responsible for medical expenses. SECTION 9: WEATHER CONDITIONS I understand that weather conditions may affect scooter operation. These may include: * Rain * High winds * Poor visibility * Flooding * Slippery surfaces I voluntarily accept these risks. SECTION 10: RELEASE OF LIABILITY To the fullest extent permitted by law, I release and discharge: ISLAND ESCAPE RENTALS its owners, employees, agents, contractors, representatives, successors, and assigns from any claims arising from: * Personal injury * Property damage * Financial loss * Medical expenses * Emotional distress * Death arising from my participation in rental activities. SECTION 11: PHOTO & VIDEO RELEASE YES / NO I grant Island Escape Rentals permission to use photographs and videos taken during my rental experience for: * Social Media * Marketing * Advertising * Promotional Materials without compensation. SECTION 12: GOVERNING LAW This Agreement shall be governed by the applicable laws of Sint Maarten. Any disputes shall be resolved in the appropriate courts of Sint Maarten. SECTION 13: SEVERABILITY If any provision of this Agreement is found unenforceable, all remaining provisions shall remain in full force and effect. SECTION 14: ACKNOWLEDGEMENT By signing below, I certify that: * I have read this agreement. * I understand this agreement. * I voluntarily agree to this agreement. * I understand the risks involved. * I understand my financial responsibilities. * I understand that I may be giving up certain legal rights.
